Persönlichkeitsrechte dienen dem unmittelbaren Schutz der menschlichen Person § 16 und gelten teilweise auch bei juristischen Personen Ehre, Namensrecht. Bei drohender Verletzung besteht ein Unterlassungsanspruch, bei tatsächlicher Verletzung besteht Anspruch auf Schadenersatz und verschuldensunabhängig auf Beseitigung der Beeinträchtigung. Es ist bei allen Beeinträchtigungen eine Interessenabwägung durchzuführen. Einzelne Persönlichkeitsrechte:
- Recht auf Leben und körperliche Unversehrtheit § 1325 ABGB
- Recht auf Freiheit §§ 16,1329 ABGB mit Ausnahme von Haft und Unterbringung
- Namensrecht § 43 inkl. Decknamen, Künstlerinnennamen, Firmenname, Domainname
- Recht am eigenen Bild § 78 UrhG
- Schutz vertraulicher Aufzeichnungen § 77 UrhG
- Schutz auf Ehre und wirtschaftlichen Ruf § 1330
- Schutz des geistigen Eigentums und der Erfinderinnenehre
- Glaubens- und Gewissensfreiheit
- Recht am gesprochenen & geschriebenen Wort
- Achtung der Privatsphäre

Personal rights serve the direct protection of the human person § 16 and partially also apply to legal entities honor and name rights. If there is a threat of injury, there is a right to injunctive relief; if there is an actual violation, there is a right to compensation and, regardless of fault, to have the impairment removed. A balancing of interests must be carried out for all impairments. Individual personal rights:
